Parking Usage Regulations
These regulations define the rules for using the parking lots at Park Hotel in Bydgoszcz.
REGULATIONS FOR PAID EXTERNAL PARKING AT PARK HOTEL BYDGOSZCZ
These regulations define the rules for using the External Parking described herein, including the collection of fees and other charges therefrom.
§ 1
General Provisions.
Parking Usage Rules.
- Terms used in the regulations mean:
1.1 The parking is intended for Guests, Clients, and hotel employees. In case of detecting unauthorized use of the parking
by unauthorized persons, the Hotel or a person acting on its behalf has the right to impose a wheel lock on an improperly parked vehicle and make its removal conditional on payment of a fine to the Hotel for unauthorized parking in the amount of 150.00 PLN;
1.2 HOTEL – Park Hotel Bydgoszcz located at Wrocławska 3, 85-211 Bydgoszcz;
1.3 LPR System – license plate recognition system
1.4 Parking Time – the period for which the Rental Agreement is concluded, but not longer than 240 hours, unless a monthly or annual subscription has been purchased.
1.5 Free Parking Time – a period up to 15 minutes from the moment of entering the Parking, during which hotel clients acquire the right to free use of the Parking.
1.6 Contractual Penalty – a penalty imposed on the Lessee for violations of the obligations specified in §6 of these Regulations.
1.7 Automatic Barriers – devices installed on the Parking premises adapted to open and close the entry/exit to the parking with built-in license plate readers;
1.8 Hotel Employee – a person authorized to control compliance with the provisions of the Regulations and issue Summons;
1.9 Parking Space – a parking space marked with horizontal lines designated for parking vehicles on the Parking;
1.10 Lessee – a person who enters the Parking area with a vehicle, provided that for Lessees using the Parking based on a subscription agreement with the Hotel, the provisions of these Regulations concerning Lessees apply to the extent that the subscription agreement does not state otherwise;
1.11 Parking Fee – a fee for renting a Parking Space during Parking Time, payable by the Lessee at the hotel reception;
1.12 Parking – the area of paid, unguarded parking with designated Parking Spaces located near the Park Hotel building;
1.13 Regulations – these Parking regulations;
1.14 Rental Agreement – a rental agreement for a Parking Space concluded between the Lessee and the Hotel in accordance with § 2 of the Regulations;
1.15 Summons – a document issued and left by the Controller under the vehicle's windshield wiper, calling the Lessee to pay a Contractual Penalty in cases specified in the Regulations;
1.16 Repeated Summons – a summons to pay the Contractual Penalty sent to the Lessee's residence or business address if the obligations specified in the Summons have not been paid;
1.17 No Parking – areas within the Parking where parking is prohibited, including: roads intended for vehicular traffic including shoulders, sidewalks, green areas, lines marking the boundaries of Parking Spaces, Parking Spaces reserved for disabled or special categories of vehicles according to applicable signage (if the Lessee is not entitled to use the reserved Parking Space) and pedestrian crossings.
§ 2
Conclusion of Rental Agreement.
- The Rental Agreement is concluded with the Hotel on the terms set out in these Regulations at the moment the Lessee's vehicle enters the Parking, and the rental period ends when such vehicle leaves the Parking. Entry to the Parking is tantamount to accepting these Regulations.
- To enter the Parking, one must:
2.1. Drive up to the entry control barrier and after the parking system correctly reads the vehicle's license plate, enter the Parking and occupy a space within the marked lines;
2.2. For Lessees using the Parking based on a subscription agreement with the Hotel, the license plate recognition system will automatically raise the barrier. - To exit the Parking, one must:
3.1. Pay the Parking Fee at the Hotel Reception, and then within 15 minutes, drive the vehicle to the exit control machine and leave after the parking system correctly reads the vehicle's license plate. - If the license plate number is not read by the parking system, please contact the hotel reception by phone at +48 52 376 36 26.
- Upon entering and exiting the Parking, wait for the barrier to open completely, then drive through without stopping. Early entry, stopping, or reversing during entry or exit may cause damage to the vehicle or parking devices. The Hotel is not responsible for vehicle damage resulting from the Lessee's failure to comply with the Regulations.
- The Lessee has the right to withdraw from the Rental Agreement by promptly leaving the Parking area, no later than 15 minutes after the vehicle's entry to the Parking, thus making the Rental Agreement void.
- If the Lessee does not leave the Parking within 15 minutes of paying the Parking Fee at Reception according to point 3.1 above, the Rental Agreement is deemed concluded again after the 15-minute period expires, and the Lessee is obliged to pay another Parking Fee in accordance with the current Parking fee schedule.
- The Hotel may decide to temporarily close the Parking, limit the number of available spaces, change its purpose, change prices, or modify opening hours.
§ 3
Lessee’s Duties.
Responsibility for vehicle and damages.
- The Lessee is obliged to comply with the Regulations.
- The Lessee is obliged to pay the applicable fees and costs specified in the Regulations.
- The Parking is unguarded, and the Hotel does not supervise or take care of the vehicle or any property left therein. In particular, no depositary contract is concluded.
- The Lessee is responsible for any damage caused by leaving the vehicle on the Parking or not complying with the Regulations. The Lessee must immediately, and no later than before leaving the Parking, inform a Park Hotel employee at the reception of any damage and the accompanying circumstances.
§ 4
Payment of Parking Fee.
- The Parking Fee is paid by paying the due amount at the Reception according to the current Parking fee schedule, providing the vehicle registration number at the hotel reception in advance. The price list contains gross prices, including the applicable goods and services tax.
- The cost of parking a passenger vehicle for 1 hour is 3.00 PLN.
- To receive a VAT invoice including the Parking Fee paid, it is necessary to inform the hotel reception before payment settlement.
- Fees for using the Parking apply 7 days a week, 24 hours a day.
- Information on applicable Parking Fee rates and Contractual Penalties is available at the Hotel Reception.
§ 5
Contractual Penalty.
- Park Hotel may charge the Lessee a Contractual Penalty of 50.00 PLN (fifty zlotys, 00/100), imposed in the form of a Summons, payable by bank transfer to the account number indicated on such Summons, if the Lessee breaches obligations specified in § 6, for each such breach. Park Hotel may seek compensation exceeding the stipulated Contractual Penalty.
- A hotel employee controls compliance with the provisions of the Regulations and issues Summons for payment of the Contractual Penalty, placing them on the vehicle while keeping a copy.
§ 6
Order and safety on the Parking.
On the Parking premises, the following are prohibited:
1) entry and presence of vehicles:
a) transporting firearms or illegal, flammable, corrosive, explosive, dangerous, or otherwise similar substances unless the Lessee presents the appropriate permit required by law, and the substances are properly secured according to regulations and technical knowledge;
b) with a permissible total weight exceeding 2.5 tons;
c) with a trailer;
d) in technical condition that may pose a threat to health or property, including, in particular, with a leaking fuel system;
2) fueling, maintenance, repair, washing, vacuuming of vehicles;
3) polluting the Parking, including emission of exhaust fumes above permitted amounts, damaging surfaces by reckless driving, or leakage of operating fluids;
4) storage of any movable property, fuels, flammable substances, and empty containers;
5) towing vehicles;
6) use of fire;
7) parking vehicles:
a) in places subject to No Parking;
b) outside designated Parking Spaces;
c) in a manner that prevents other Lessees free access to other Parking Spaces and parked vehicles;
d) with the engine running;
8) moving at speeds exceeding 20 km/h;
9) disobeying instructions from hotel employees;
10) actively or passively creating danger on the Parking premises;
11) noncompliance with the Road Traffic Act (consolidated text: Journal of Laws of 2017, item 1260, as amended).
§ 7
Personal Data Protection
- Park Hotel processes personal data of Lessees for the following purposes:
a. photos of the vehicle (including license plates, make, and model) – to pursue payment of Contractual Penalties from those Lessees who do not comply with these Regulations, including obtaining information from the LPR system about the owner, holder or user of the vehicle, as well as to ensure the safety of persons and property on the Parking, and to defend or enforce claims related to the Lessee's non-compliance with the Regulations or law, especially damages caused;
b. first and last name, company under which the Lessee conducts business, business address, and tax identification number (NIP) – to fulfill legal obligations imposed on the Hotel by generally applicable law, including tax and accounting law;
c. first and last name, address, and vehicle registration number of the person making a complaint – for handling the complaint. - The data controller of the Lessee's personal data specified in section 1 is Park Hotel Bydgoszcz;
- The Hotel processes Lessees' personal data for the following purposes:
a. first and last name, company, business address, and NIP – to fulfill legal obligations imposed on the Hotel by generally applicable law, including tax and accounting law; - Personal data are processed in the legally justified interests of the data controller specified in section 1.
- Providing personal data, and therefore their processing, is necessary for the realization of the legally justified interests of the data controller in the scope indicated above.
- Personal data may be disclosed to the following recipients or categories of recipients:
a. public authorities and entities performing public tasks or acting on behalf of public authorities, in the scope and for the purposes resulting from legal provisions, e.g. police, courts;
b. entities supporting the administrator in its business processes, including entities processing personal data on behalf of the Hotel (data processors), including the Parking System Manager; - Personal data will not be transferred outside the European Economic Area or to an international organization.
- The Lessee whose data are processed has the following rights:
a. right of access to personal data, including the right to obtain a copy of such data;
b. right to request correction of personal data if inaccurate or incomplete;
c. right to demand deletion of personal data (the "right to be forgotten") where (i) data are no longer necessary for the purposes for which they were collected or processed otherwise, (ii) the data subject objects to the processing, (iii) the data subject withdraws consent on which processing is based and no other legal basis for processing exists, (iv) data are processed unlawfully, (v) data must be erased to comply with a legal obligation;
d. right to request restriction of processing where:
(i) the data subject contests the accuracy of the personal data,
(ii) processing is unlawful and the data subject objects to the erasure of the data, requesting restriction instead;
(iii) the controller no longer needs the data for its purposes but the data subject requires them for the establishment, exercise, or defense of legal claims, (iv) the data subject has objected to the processing pending the verification of the legitimate grounds of the controller overriding the grounds for objection;
e. right to data portability where:
(i) processing is based on a contract with the data subject or consent given by the data subject, and
(ii) processing is carried out by automated means;
f. right to object to the processing of personal data, including profiling, where:
(i) there are grounds related to the particular situation of the Lessee, and
(ii) processing is based on the necessity for the purposes of legitimate interests; - The Lessee has the right to lodge a complaint with the supervisory authority.
- Personal data will not be subject to profiling or automated decision-making.
- Personal data will be processed only for the duration of the rental, and after its expiration only if any claims are raised, for the period necessary to effectively conduct investigations or defend claims, unless the necessity to retain data for a different period stems from legal provisions (in particular but not limited to the Value Added Tax Act, Tax Ordinance) – then personal data will be processed for the period specified in those provisions.
- Questions regarding the method and scope of personal data processing and rights should be directed to the appropriate data controller.
§ 8
Complaint and Appeal Procedure.
- Complaints regarding the amount or validity of fees and the quality of services may be submitted to Park Hotel Bydgoszcz:
a. in writing to: Park Hotel Bydgoszcz Wrocławska 3 85-211 Bydgoszcz;
b. electronically to: recepcja@parkhotel.bydgoszcz.pl - To facilitate the handling of the complaint, it should include at least the complainant's name and address, the vehicle registration number, a description of the complaint subject, and a copy of the Summons, payment receipt depending on the complaint subject.
- Filing a complaint does not affect the Lessee's ability to use all available legal remedies, including dispute resolution by a common court.
§ 9
Enforcement of Fees or Penalties.
- If the Contractual Penalty is not paid within 14 days from its issuance date in the Summons, the Park Hotel, after delivering a Repeated Summons, is entitled to pursue the payment through enforcement proceedings.
- In the case specified in point 1 above, the Lessee may be additionally charged with costs related to court and enforcement proceedings and obtaining owner data.
INTERNAL PARKING REGULATIONS OF PARK HOTEL
These regulations define the rules for using the Park Hotel parking, hereinafter referred to as the "Parking." Whenever the Regulations mention "We," it should be understood as referring appropriately to the owner.
- General provisions
1.1. Every person on the Parking accepts the provisions of these Regulations and undertakes to strictly comply with them.
1.2. The Parking is open daily, 24/7. The Parking is intended exclusively for hotel clients.
1.3. The Parking is unguarded and not monitored. By leaving your vehicle in the Parking, you enter into a rental agreement with us, but the Hotel does not bear responsibility for the custody of your vehicle. The Hotel excludes liability for traffic and parking damages concerning vehicles and persons using the Parking. - We are not responsible for:
2.1. any damages resulting from theft, destruction, or damage to the vehicle caused by you or third parties, as well as accidents or natural disasters;
2.2. any items left in the vehicle or any vehicle equipment. - You bear full responsibility for damages caused to any third parties or Park Hotel property within the Parking.
- We may decide to temporarily close the Parking, limit available spaces, change its purpose, or change its opening hours.
- On the Parking premises:
5.1. there is a traffic zone; road traffic rules apply, and independently of these rules, you are obliged to comply with all signs placed on the Parking premises and all instructions from hotel staff;
5.2. parking outside designated parking spaces is prohibited;
5.3. the speed limit is 20 km/h;
5.4. the vehicle should be immobilized after parking in the designated parking space; ignition and lights should be turned off; windows, doors, and trunk should be closed; you are required to turn off all radio devices in the vehicle;
5.5. if your vehicle is improperly parked and obstructing traffic on the Parking, or parked outside designated spaces or in parking spaces for privileged/disabled persons without a visible permit on the windshield, your vehicle may be towed at your expense. - On the Parking, the following are prohibited:
6.1. leaving third parties on the Parking unless related to leaving the Parking after parking the vehicle or accessing the parked vehicle to leave the Parking;
6.2. consumption of alcohol;
6.3. smoking (except in designated areas);
6.4. littering, cleaning, washing and vacuuming vehicles, parking vehicles with leaking installation, replacement or replenishment of fluids, coolant, oil, etc. in the vehicle;
6.5. damaging any Hotel property or Parking infrastructure;
6.6. repairing, refueling, or servicing any vehicle;
6.7. use of open fire.
