§1. General provisions

  1. These Regulations set out the rules for placing orders, making payments and collecting dishes offered by Katarzyna Dobrzańska conducting business activity under the name Katarzyna Dobrzańska Park Hotel Bydgoszcz, with its registered office at ul. Wrocławska 3, 85-211 Bydgoszcz, NIP: 5542443759 (hereinafter the “Seller”).
  2. The Regulations constitute an integral part of the purchasing process and are available on the Restaurant’s website.
  3. Placing an order constitutes acceptance of these Regulations.
  4. Orders may be placed exclusively by adults with full legal capacity.

§3. Scope of activity

  1. The Seller sells restaurant dishes via the website.
  2. All products offered on the website are prepared to order in accordance with the Restaurant’s standards.

§4. Placing orders

  1. Orders may be placed via the Park Hotel Bydgoszcz website.
  2. The sales agreement is concluded when the order is confirmed by the system.
  3. The order is accepted for processing after payment has been made or cash on collection has been selected as the payment method.
  4. After placing an order, the Customer receives confirmation at the e-mail address provided in the form.

§5. Prices and payments

  1. All prices stated on the website are gross prices (PLN).
  2. Available payment methods:
    a) online payment via Przelewy24,
    b) cash payment upon collection.

  3. The Seller reserves the right to change prices; however, such changes do not apply to orders already placed.

§6. Collection of orders

  1. Orders are fulfilled exclusively by personal collection at the Seller’s registered office at ul. Wrocławska 3, 85-211 Bydgoszcz.
  2. The Seller does not deliver orders to the indicated address.
  3. The collection time is indicated when placing the order.
  4. The Customer is obliged to collect the order.

§7. Orders for alcoholic products

  1. Orders including alcoholic beverages may be placed exclusively by adults.
  2. An order containing alcoholic beverages may be collected exclusively by an adult.
  3. Upon collection of the order, the Seller has the right to verify the age of the person collecting it by requesting an identity document.
  4. If it is not possible to confirm that the person is an adult, the Seller will refuse to release the alcoholic beverages.
  5. In such a situation, the Seller may release the remaining part of the order without alcohol or cancel the items containing alcohol and refund their value.

§8. Complaints

  1. The Customer has the right to submit a complaint if the product does not conform to the order.
  2. Complaints should be submitted by e-mail to: recepcja@parkhotel.bydgoszcz.pl
  3. Complaints are considered within 14 days of receipt.
  4. If the complaint is accepted, the Seller will refund the funds or prepare the meal again.

§9. Right of withdrawal from the agreement

  1. Pursuant to Article 38(4) of the Consumer Rights Act, the right of withdrawal from the agreement does not apply to products that deteriorate rapidly or have a short shelf life, including restaurant dishes.

§10. Personal data protection

  1. The controller of Customers’ personal data is Katarzyna Dobrzańska Park Hotel Bydgoszcz.
  2. The data are processed for the purpose of fulfilling the order and in accordance with the Privacy Policy available on the website.
  3. The Customer has the right to access, rectify and delete their data, restrict its processing and object to its processing.

§11. Final provisions

  1. The Seller reserves the right to amend the Regulations; however, amendments do not apply to orders already placed.
  2. Matters not regulated by these Regulations shall be governed by the provisions of the Civil Code and the Consumer Rights Act.
  3. The Regulations shall apply from the moment they are published on the Seller’s website.

Appendix No. 1 – Allergen information

In accordance with Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, Park Hotel Bydgoszcz Restaurant informs customers about the possible presence of allergens in the dishes offered.

1. General information

  1. Dishes prepared in the Restaurant may contain allergens or traces of them.
  2. Despite the exercise of due diligence, it is not possible to completely rule out the occurrence of cross-contamination with allergens during food preparation.
  3. Customers with allergies or food intolerances should inform the Restaurant before placing an order.
  4. The Restaurant is not responsible for allergic reactions in the event that an allergy or intolerance is not reported before the order is prepared.

The following allergens or derivatives thereof may be present in the dishes offered:
  1. Cereals containing gluten (wheat, rye, barley, oats, spelt, kamut)
  2. Crustaceans
  3. Eggs
  4. Fish
  5. Peanuts (arachis)
  6. Soy
  7. Milk (including lactose)
  8. Nuts (almonds, hazelnuts, walnuts, cashews, pecans, Brazil nuts, pistachios, macadamia nuts)
  9. Celery
  10. Mustard
  11. Sesame
  12. Sulfur dioxide and sulphites (more than 10 mg/kg or 10 mg/l)
  13. Lupin
  14. Molluscs

3. Access to detailed information

  1. Detailed information on ingredients and allergens in individual dishes is available upon request from the Customer.
  2. Information is provided by the Restaurant staff or is available in the Restaurant’s information materials (e.g. the menu, ordering system).
  3. For orders placed online, the Customer has the option to contact the Restaurant before placing the order in order to obtain information about allergens.
